Traveller information form for a package tour according to § 651a of the Civil Code

The combination of travel services offered to you is considered a package tour within the meaning of EU Directive 2015/2302.
You can therefore make use of all the EU rights that apply to package tours. MC MusiCultur Travel GmbH is fully responsible for the proper conduct of the entire package tour.

In addition, MC MusiCultur Travel GmbH has the legally required insurance for the repayment of your payments and, if transport is included in the package tour, to secure your return transport in the event of its insolvency.

Main rights under the EU Directive 2015/2302:

  • Travellers will receive all the essential information about the package tour prior to the package tour contract being concluded.
  • At least one operator shall always be liable for the proper provision of all the travel services included in the contract.
  • Travellers will receive an emergency telephone number or details for a point of contact through which they can contact the travel operator or travel agency.
  • Travellers may transfer the package tour to another person within a reasonable time frame and potentially for an additional cost.
  • The price of the package tour may only be increased if certain costs (e.g. fuel prices) increase and if this is expressly provided for in the contract. In any event, this may not occur less than 20 days prior to the start of the package tour, at the latest. If the price increase exceeds 8% of the package tour price, the traveller may withdraw from the contract. If a travel operator reserves the right to increase the price, the traveller has the right to a price reduction if the corresponding costs are reduced.
  • Travellers may withdraw from the contract without paying a cancellation fee and will receive a full refund of all payments if one of the essential elements of the package tour, with the exception of the price, is substantially changed. If the operator responsible for the package tour cancels the package tour before the start of the package tour, travellers are entitled to reimbursement and may possibly be entitled to compensation.
  • In exceptional circumstances, travellers may withdraw from the contract before the start of the package tour without paying a cancellation fee, for example if there are serious security problems at the destination which are likely to affect the package tour.
  • In addition, travellers can withdraw from the contract at any time before the start of the package tour if they pay an appropriate and justifiable cancellation fee.
  • If, after the start of the package tour, essential components of the package tour cannot be carried out as agreed, other appropriate arrangements shall be offered to the traveller at no additional cost. The traveller can withdraw from the contract without paying a cancellation fee (in the Federal Republic of Germany, this right is called "termination") if services are not provided in accordance with the contract and if this has a considerable impact on the provision of the contractual package tour services, and the travel operator fails to remedy the situation.
  • The traveller is entitled to a price reduction and/or compensation if the travel services are not provided or are not provided properly.
  • The travel operator shall provide assistance to the traveller in the event of difficulties.
  • Payments shall be refunded in the event of the insolvency of the travel operator or, in some Member States, the travel agent. If the tour operator or, if relevant, the travel agent becomes insolvent after the start of the package tour and if carriage is part of the package tour, passengers will be repatriated. Travellers may contact this institution or the competent authority if they are denied services due to the insolvency of MC MusiCultur Travel GmbH.
